California agents raided David Daleiden's home on Kamala Harris's watch after his hidden-camera Planned Parenthood videos.
Now a Minnesota prosecutor is aiming that same revenge lawfare weapon at two more hidden cameras.
Her targets walked into Minneapolis polling places in disguise, asked one question and never touched a ballot.
Mary Moriarty Charged O'Keefe and Higby With Unlawful Voting and Identity Theft
Hennepin County Attorney Mary Moriarty filed felony charges against James O'Keefe and Cam Higby on October 28.
The counts are unlawful voting and identity theft.
Each charge carries up to five years in prison, according to the Daily Caller.
The alleged crime happened during Minnesota's August 11 primary.
O'Keefe and Higby walked into several Minneapolis precincts in Islamic garb with hidden cameras rolling.
Higby covered himself in a burqa.
The YouTube version, posted August 14, carried the title "I Wore Burqa To EXPOSE Election FRAUD In Minneapolis."
O'Keefe put on an accent and asked poll workers whether he could vouch for his companions so they could register and vote on the spot.
At every stop, they asked the question and walked out without finishing a registration.
Neither man signed a vouching oath.
Neither man cast a ballot.
Moriarty's case rests on the names the pair gave election judges, which belonged to registered voters, some of them dead.
Then she said the part that should alarm every reporter in America.
Moriarty declared that for anyone who identifies as a journalist, "there is no such thing as undercover investigation in the polling place."
Higby called the charges lawfare and launched a fundraiser for his defense.
He says the video "showed how Minnesota allows cheating in elections."
Minnesota Lets One Voter Vouch for Eight Others On Election Day
The target of the stunt was Minnesota's vouching law.
A registered voter can vouch for the residency of up to eight people so they can register and vote at the polls that same day.
Those voters still need a Minnesota driver's license or ID number, or the last four digits of a Social Security number.
The voter doing the vouching signs an oath under penalty of perjury.
State officials like to point out that fewer than 0.6% of votes in the 2024 general election used vouching.
In a state that cast more than three million ballots, that is still thousands of voters walking in on someone else's word.
Secretary of State Steve Simon insists the poll workers did exactly what they were supposed to do.
His office blasted the video in August as heavily edited and ignorant of Minnesota election law.
Then it sent the case to prosecutors anyway, flagging O'Keefe and Higby for trying to undermine the vouching system.
So if the safeguards worked, where is the felony?
Moriarty accused the pair of trying to sow doubt about Minnesota's voting system.
She even conceded that being offensive or performative is not against the law.
Embarrassing the people who run an election is not a crime.
It is a news story the people in charge do not like.
RedState's Brad Essex nailed it: "Treating the probe itself as the primary crime risks teaching the wrong lesson."
California Dragged David Daleiden Through Court for Nine Years
Minnesota did not invent this tactic.
Kamala Harris opened the investigation into Daleiden's Center for Medical Progress while she was California's attorney general.
In 2017, prosecutors under her successor, Xavier Becerra, filed 15 felony counts against Daleiden and his colleague Sandra Merritt.
The case finally ended in January 2025 with a no-contest plea to a single charge and no fines or prison time.
Daleiden described the case as "a totally weaponized political prosecution."
Nearly a decade of legal bills, all for footage the public had every right to see.
Meanwhile, citizen journalists with cameras keep exposing what Minnesota officials missed.
After Nick Shirley's viral video showed seemingly empty Minnesota daycare centers raking in taxpayer money, the Department of Health and Human Services announced on December 30, 2025, that it would halt child care payments to the state.
State officials attacked Shirley's methods.
Federal officials acted on what he found.
Moriarty Just Told Every Citizen Journalist to Leave the Camera At Home
O'Keefe asked poll workers one question, and a progressive prosecutor answered with felony charges carrying years behind bars.
If the vouching system is as airtight as Simon claims, a hidden camera should be its best advertisement.
Instead, Hennepin County decided the man holding the camera is the criminal, with the November 3 general election bearing down.
Every independent reporter who wants to test an American election now knows the price of asking: a felony complaint and a court date on November 16.
