Democrats spent the birthright citizenship fight screaming that one judge should never override the entire country.
A single Boston judge just proved that fight is far from over.
Now the fight over her order sits at the Supreme Court with the midterms closing in.
Judge Talwani Blocks USPS From Enforcing Mail-In Ballot Standards Nationwide
Judge Indira Talwani sits in Boston.
On Tuesday, she granted a preliminary injunction against Section 3 of Executive Order 14399.
That section stops the Postal Service from refusing to transmit fraudulent mail-in ballots.
Trump signed the order in March.
It directs the Department of Homeland Security to build lists of eligible voters and hand them to the states.
It orders USPS to set real standards for mail ballots for the first time in American history.
It tells the Justice Department to investigate local election officials who hand ballots to people who shouldn't have them.
Trump summed up the whole problem in one line: "The cheating on mail-in voting is legendary. It's horrible what's going on."
Talwani's ruling blocks that fix in 23 states right before the November 3 midterms.
A federal appeals court already refused to pause her first ruling.
The Trump administration's emergency plea has been sitting at the Supreme Court since late July.
Solicitor General Sauer Tells the Supreme Court Lower Courts Are Hijacking the Executive Branch
Solicitor General D. John Sauer did not hold back.
He called the injunction "extraordinary."
He told the justices it "operates as an improper intrusion by a federal court into the workings of a coordinate branch of the Government."
Sauer's point is simple.
DHS and USPS are still drafting implementation plans.
They haven't taken final action on anything.
A judge in Boston stopped them anyway – months before Election Day, in the middle of the planning stage.
Sauer warned the justices that the clock is the real enemy here.
If the administration wins on appeal after the midterms, the damage to ballot integrity "cannot be undone."
Executive Order 14399 isn't some fringe idea Trump dreamed up alone.
DHS building voter eligibility lists and handing them to states is basic housekeeping every secure election system needs.
USPS refusing to run mail through a system with zero verification standards is common sense, not suppression.
Talwani's injunction doesn't touch any of that reasoning.
It just stops the fix cold and leaves the old, unverified system running straight through November.
The League of Women Voters of Massachusetts is thrilled with the ruling.
They call it a win for "one of our most sacred constitutional rights."
Nobody at that organization has to explain why the Postal Service should be legally required to deliver ballots that never should have been mailed in the first place.
Massachusetts Attorney General Andrea Campbell sued to trigger this exact outcome.
She called blocking Trump's order a win that "protects the fundamental right of every eligible voter to participate freely and fairly in our democracy."
Campbell never explains why protecting that right requires the Postal Service to keep running unverified mail ballots through Election Day.
Talwani's own order first surfaced back in June, when she blocked earlier pillars of the same executive order.
She didn't stop there.
She came back in August and expanded the block right as ballots start going out for November.
That's not one ruling anymore.
That's a pattern of one judge steering national election policy from a single courtroom in Boston.
This is the same movie Americans watched with Trump's birthright citizenship order.
One federal judge tried to block that policy nationwide too.
The Supreme Court had to step in last year and strip judges of that power, ruling that a single district court cannot dictate policy for the entire country from one courtroom.
Talwani just tested that limit again with an injunction that reaches into 23 states at once.
Andrea Campbell Is Betting the Clock Runs Out Before the Midterms
Andrea Campbell is betting the Supreme Court won't move fast enough to matter before November.
That's the whole strategy – tie up the order in injunctions, run out the clock, and let the midterms happen under the old rules Democrats like.
Sauer's filing calls that out directly: this isn't about protecting voters, it's about making sure a fix nobody can undo never gets the chance to work.
The Supreme Court already told lower courts to stop ruling like national legislatures when it gutted nationwide injunctions in the birthright citizenship case.
Talwani ignored that lesson and blocked USPS in 23 states anyway.
Democrats know full well the fix works, which is exactly why they need it dead before voters ever see it in action.
If the justices don't step in fast, Trump's entire election security order dies of old age before a single ballot standard ever takes effect.
