The FBI’s unconstitutional surveillance operation will be a big fight

President-elect Donald Trump nominated his former White House official Kash Patel to be the new director of the FBI. 

He’s going to be walking into a mess at the FBI after years of weaponization and politicization of the bureau, starting with its leadership. 

The FBI received a massive expansion of its surveillance power over American citizens after it failed to stop the 9/11 terrorist attacks.  The bureau was adamant those spying powers come along with a shift in its mission, but law-abiding Americans never expected they’d be turned inward against them. 

Nevertheless, FBI officials abused power by weaponizing these surveillance tools against Americans. 

The Justice Department admitted that the FBI illegally spied on 2016 Trump campaign official Carter Page using FISA false information in its application to place him under surveillance. 

Patel wants to return the FBI to fighting crime instead of being a domestic spying agency for the Deep State. 

Former FBI special agent Chris Piehota outlined what the incoming FBI director could do to the agency’s domestic snooping. 

“National security is basically authorized under the Foreign Intelligence Surveillance Act,” Piehota explained. “That is the authoritative document where the FBI derives its ability to conduct surveillance against its investigative targets.”

RINO Speaker of the House Mike Johnson (R-LA) cast the deciding vote to renew Section 702 of FISA in April, which allows for warrantless spying on Americans. 

“That’s where you have the infamous FISA court — where if you want to do certain kinds of technical surveillance and operations, the information has to be placed into an affidavit that is approved by about 500 people in between the affiant and the judge who reviews the package and then approves the coverage,” Piehota stated. 

The U.S. Foreign Intelligence Surveillance Court was created by FISA to secretly hear requests to spy on Americans. 

People who have requests to be placed under surveillance have no chance to defend themselves.

Kash Patel’s curveball for the FBI’s surveillance operation 

The Washington, D.C., Swamp wants to keep FISA going at any cost. 

Former FBI agent Steve Friend said that there are actions that Patel could take against FISA even if Congress supports it. 

“I think the FBI would be well suited to, even though they can get those without a warrant, I think they should voluntarily get warrants for legitimate reasons,” Friend stated. “I think that’s a good practice.”

Former President Barack Obama updated President Ronald Reagan’s Executive Order 12333, which expanded the FBI’s surveillance powers. 

“[12333] authorizes the FBI to get unfettered access [to] raw signals intelligence without any sort of court proceeding,” Friend said.

FBI whistleblower Kyle Seraphin said that Patel needs to return the FBI to its roots. 

“The single biggest thing Kash Patel can do to restore the FBI’s purpose is focus on criminal violations of federal law, and specifically cases that are worthy of the resources it will take to prove them,” Seraphin said. “This will require a dramatic shift away from the cancerous legacy of post 9/11 intelligence work and the disastrous update of Executive Order 12333 by Barack Obama in 2016.”

Kash Patel has his work cut out for him reforming the FBI when he takes over next year.
