But that doesn’t mean Smith is going away quietly.
And now Jack Smith is planning this final middle finger to Donald Trump.

Jack Smith formally surrendered to Donald Trump when he filed a motion to drop criminal charges in the January 6 and Mar-a-Lago documents hoaxes.
Smith told the court that the Constitution’s prohibition against prosecuting a sitting President meant these cases couldn’t move forward.
“After careful consideration, the Department has determined that OLC’s prior opinions concerning the Constitution’s prohibition on federal indictment and prosecution of a sitting President apply to this situation and that as a result this prosecution must be dismissed before the defendant is inaugurated,” Smith’s motion requesting dismissal read.
Smith is also planning to resign as special counsel before Trump can have the pleasure of firing him on his first day in office.
It was a 100 percent total victory and vindication for Donald Trump.
But Smith can still get one cheap shot on his way out the door.
Special counsels are required to submit a report to the Attorney General summarizing their findings.
It’s then up to the Attorney General to decide what to do with it.
Smith plans to submit a scathing report to Attorney General Merrick Garland before Trump takes office.
“The report is expected to detail Smith’s findings on key cases involving Trump, including allegations of election subversion and mishandling of classified documents. Attorney General Merrick Garland is expected to publicly release the special counsel report,” Newsweek reported.
CNN’s legal analyst Elie Honig said he expected Smith’s report to go into excruciating detail to attack Donald Trump as a criminal.
“Historically, these special counsel reports are quite detailed,” Honig told host Jim Acosta.
“I think this will be Jack Smith’s last and best chance to tell his story in both cases. He’s already done that to some extent through his indictments and court filings, but this will be it — this will be the historical record.”
Attorney General Merrick Garland will surely release the report as one final shot at Donald Trump.
