Judge strikes down Biden’s attempt to redefine “sex” in federal law
Federal Judge Matthew Kacsmaryk of the U.S. District Court for the Northwestern District of Texas ruled against a Biden-era Equal Employment Opportunity Commission (EEOC) guidance that attempted to redefine sex discrimination.
The ruling declared that language in the guidance defining “sex” in Title VII as encompassing sexual orientation and gender identity is “contrary to law.”
Judge Kacsmaryk, who was appointed by President Trump during his first term, also ruled against “all language defining ‘sexual orientation’ and ‘gender identity’ as a protected class.”
This ruling marks a significant victory for biological reality in the workplace.
The case stemmed from a legal challenge brought by the Heritage Foundation, a conservative think tank, and the state of Texas against the Biden administration’s EEOC guidance.
Biden officials tried to force Americans to deny biological reality
The Biden-Harris administration had been attempting to expand Title VII protections against sex-based employment discrimination to include sexual orientation and gender identity through regulatory guidance.
This would have forced employers to accommodate biological males in women’s spaces and compelled speech through mandatory pronoun usage.
“Sex-based discrimination under Title VII includes employment discrimination based on sexual orientation or gender identity,” the EEOC’s Enforcement Guidance on Harassment in the Workplace had claimed. “Accordingly, sex-based harassment includes harassment based on sexual orientation or gender identity, including how that identity is expressed.”
Dr. Kevin Roberts, president of the Heritage Foundation and Heritage Action for America, celebrated the ruling.
“The Biden EEOC tried to compel businesses – and the American people – to deny basic biological truth,” Roberts said in a statement. “Thanks to the great state of Texas and the work of my Heritage colleagues, a federal judge said: not so fast.”
“This ruling is more than a legal victory. It’s a cultural one,” he added. “It says no – you don’t have to surrender common sense at the altar of leftist ideology. You don’t have to pretend men are women. And you don’t have to lie to keep your job.”
Trump administration welcomes common-sense ruling
The Trump White House quickly celebrated the ruling, calling it a “major win for women and commonsense.”
White House spokesman Harrison Fields told Fox News Digital that the judge “confirmed what the Trump Administration consistently maintains: government-imposed DEI policies requiring bathroom, dress, and pronoun accommodations are illegal.”
On his first day back in the White House, President Trump issued an executive order declaring it U.S. policy “to recognize two sexes, male and female.” That order specifically called for rescinding guidance documents, including the EEOC’s Enforcement Guidance on Harassment in the Workplace, that conflicted with biological reality.
Radical liberals fight to preserve their agenda
Despite Trump’s executive order, some holdover Biden appointees at the EEOC initially refused to change course.
EEOC Commissioners Charlotte Burrows, Jocelyn Samuels, and Kalpana Kotagal issued a joint statement in January claiming that “like all workers, LGBTQI+ workers — including transgender workers — are protected by federal law and entitled to the full measure of America’s promise of equal opportunity in the workplace.”
President Trump subsequently removed Burrows and Samuels from their roles as EEOC commissioners.
The EEOC currently lacks a full quorum of commissioners needed to rescind guidance documents. The commission is now led by Republican Acting Chair Andrea Lucas, who was designated by President Trump on January 20, along with Democrat Commissioner Kalpana Kotagal.
This court decision ensures that normal definitions of biological sex remain in federal employment law, protecting women’s spaces in the workplace from Biden’s radical gender ideology.
Judge Kacsmaryk’s ruling is part of a broader effort by the Trump administration to restore commonsense definitions of sex and gender throughout the federal government. The administration has pledged to continue undoing the damage caused by years of woke gender policies.
