Senate Hearing Erupts as Rand Paul Catches Fauci’s Lawyer Breaking a Rule No Judge in America Would Allow

Anthony Fauci hid behind the Fifth Amendment more than one hundred times during the Senate COVID hearing.

Fauci's own lawyer then tried to directly intervene in the committee hearing.

Rand Paul caught it instantly and ordered the lawyer thrown out of the room.

Fauci Takes The Fifth And His Lawyer Gets Thrown Out Of The Room

Dr. Anthony Fauci sat before the Senate Homeland Security and Governmental Affairs Committee on Wednesday and refused to answer a single substantive question about his handling of COVID-19.

Nobody in the room could even agree on the final count, with estimates on his Fifth Amendment pleas ranging from the eighties well past a hundred.

This is the same man who spent years telling America he personally represented science.

Fauci's attorney kept trying to speak up on his behalf even though the committee had never called on him.

Rand Paul had seen enough and ordered security to remove the lawyer from the room.

Paul has now scheduled a vote to hold Fauci in contempt of Congress.

Senator Josh Hawley tested just how far Fauci would take the stonewalling.

Hawley asked Fauci a simple, harmless question about the color of the tie he was wearing.

Fauci pleaded the Fifth Amendment to that too.

A man who says he testified before Congress over 200 times couldn't bring himself to answer a question about his own necktie.

The Rule Fauci's Lawyer Broke And Blumenthal's Failed Defense Of It

Connecticut's Richard Blumenthal decided this was the moment to defend Fauci's honor.

Blumenthal painted the entire hearing as an unfair pile-on against one man rather than a legitimate investigation.

Paul wasn't buying the theatrics.

He explained a basic rule of American law that Blumenthal apparently forgot: "In no courtroom in America can you have your witness plead the Fifth Amendment" and then let his lawyer testify on his behalf.

A witness who invokes the Fifth doesn't get to send in a substitute to argue his case for him.

Fauci's own attorney broke that exact rule live on camera, and Blumenthal had no answer for it.

Blumenthal wasn't finished trying to rescue Fauci's reputation either.

He praised Fauci's decades of public health work and accused Republicans of demeaning life-saving service.

Senator Gary Peters piled on, calling the hearing counterproductive and warning it would scare good scientists away from public service.

Senator Ruben Gallego accused Republicans of appeasing a small base still stuck in COVID times.

Only one Democrat broke ranks.

John Fetterman admitted the lab leak theory got dismissed as right wing nonsense early on when it deserved a real look.

Fetterman said Congress should pursue the truth no matter where it leads.

His own party colleagues weren't interested in following him there.

The Pardon Question Nobody In The Room Wanted To Answer

Fauci is sitting on a blanket pardon from Joe Biden covering his conduct through January 19, 2025.

That should have ended the Fifth Amendment argument before it started.

Constitutional scholars don't see it that way.

Legal fellow Hans von Spakovsky said Fauci could still face prosecution if his current testimony turns out to be false, since he'd be "being prosecuted for lying to the committee now."

State prosecutors are also untouched by a federal pardon, which means Fauci's shield has holes in it big enough to drive a truck through.

This isn't new territory for Congress either.

Back in 2014, IRS official Lois Lerner tried a similar Fifth Amendment dodge during the Tea Party targeting scandal, and lawmakers spent years fighting over whether she'd waived her rights by proclaiming innocence first.

Fauci's lawyers were smarter this time, offering no innocence claim, just silence, over and over again.

That silence is exactly what should worry him.

If Congress grants him immunity, every excuse disappears and he has to answer or go to prison for contempt.

Paul has made clear he wants that vote, and he wants it soon.

Millions of Americans lost jobs, schools, and years of their children's education under the guidance of a man who wouldn't even confirm the color of his own tie under oath.

Blumenthal wants you to forget all of that and salute him instead.

Rand Paul isn't buying it, and neither should you.
