Obama Judge threatens to criminalize deportations
U.S. District Court Judge Brian Murphy, appointed by Barack Obama, is threatening to hold Trump officials in contempt and possibly pursue criminal sanctions against them for deporting dangerous criminals.
Judge Murphy ordered Trump administration officials to maintain custody of illegal aliens on a deportation flight reportedly headed to South Sudan, claiming the move likely violated an injunction he issued in April.
“Based on what I have been told,” Murphy said during the hearing, “This seems like it may be contempt.”
The judge warned that officials involved in the deportations who were aware of his order could face criminal sanctions – including the pilots of the deportation flight. This extraordinary threat effectively tries to criminalize the Trump administration’s enforcement of immigration law.
While Murphy stated he would not order the plane to “turn around,” he insisted that any aliens in DHS custody couldn’t leave U.S. control once the plane landed until he holds a hearing on Wednesday to determine whether the deportees had received enough “due process” for his liking.

The illegal aliens being deported include some of the most dangerous criminals imaginable:
- Enrique Arias-Hierro from Cuba, convicted of homicide and armed robbery
- Jose Manuel Rodriguez-Quinones from Cuba, convicted of attempted first-degree murder with a weapon
- Thongxay Nilakout from Laos, convicted of first-degree murder and robbery and sentenced to life in prison
- Jesus Munoz-Gutierrez from Mexico, convicted of second-degree murder and sentenced to life confinement
- Kyaw Mya from Burma, convicted of lascivious acts with a child under 12 years of age
- Nyo Myint from Burma, convicted of first-degree sexual assault involving a mentally and physically incapable victim
- Tuan Thanh Phan from Vietnam, convicted of first-degree murder and second-degree assault
These are not innocent migrants seeking a better life – they’re dangerous felons who have already been convicted of heinous crimes including child rape and murder.
DHS fires back at judicial overreach
During a press conference on Wednesday, DHS spokeswoman Tricia McLaughlin confirmed that these eight illegals were deported from America. She delivered a blistering response to Judge Murphy’s threats against Trump officials.
“A local judge in Massachusetts is trying to force the United States to bring back the uniquely barbaric monsters who present a clear and present threat to the safety of the American people and the victims,” McLaughlin said. “While we are fully compliant with the law and court orders, it is absolutely absurd for a district judge to try to dictate the foreign policy and national security of the United States of America.”
McLaughlin highlighted the stark contrast between the administration’s priorities and the judge’s actions.
“The contrast is brutally stark,” she added. “President Trump and Secretary Noem are working every single day to get these vicious criminals off of American streets. And while activist judges are on the other side, fighting to get them back onto United States soil.”
Judge Murphy’s history of siding with criminals
This isn’t the first time Judge Murphy has interfered with the Trump administration’s immigration enforcement. Last month, he barred the Department of Homeland Security from transferring illegal aliens to other agencies like the Department of Defense after four Venezuelan gang members were flown from Guantanamo Bay to El Salvador.
The South Sudanese government, for its part, stated they had not received any deportees but indicated that individuals would be “re-deported” if found not to be South Sudanese citizens.
As DHS continues its mission to remove dangerous criminal aliens from American communities, this judicial overreach represents yet another obstacle to the Trump administration’s efforts to fulfill its promises to the American people on border security and public safety.
