Megyn Kelly blasts a Democrat lawyer for defending the judicial coup against Trump
President Donald Trump is facing a judicial coup by Democrat District Court judges who are trying to grind his agenda to a halt.
District Court judges are using nationwide injunctions and restraining orders to force the country to follow political rulings they make from the bench.
Trump is having his constitutional powers as President stripped from him because of these activist judges.
D.C. District Court Judge James Boasberg – who was appointed by former President Barack Obama – seized control of the country’s foreign policy and national security.
Boasberg blocked Trump from using the Alien Enemies Act to deport terrorist illegal aliens and ordered a plane carrying more than 200 gang members to El Salvador to turn around in mid-flight and return to American soil.
Democrat Florida State Attorney Dave Aronberg defended Boasberg’s actions during an appearance on SiriusXM’s The Megyn Kelly Show.
Kelly went off on him for allowing the judge to set national security policy by halting the use of the Alien Enemies Act.
“OK, but Dave, how is it that the federal district courts are allowed, in the argument of the ACLU, to decide whether there’s been an incursion, a predatory incursion, by a foreign government?” Kelly asked. “How are they better positioned to determine that than the Commander-in-Chief and the sitting President of the United States?”
A 1948 Supreme Court ruling found that deportations under the Alien Enemies Act weren’t subject to judicial review.
“Well, they’re entitled to interpret the Alien Enemies Act, and here the judge is saying there’s not been a declaration of war, and so this act does not apply, does not give the executive branch the authority to make these decisions,” Aronberg replied.

Kelly noted that a declaration of war wasn’t the only justification for invoking the Alien Enemies Act.
“You’re not answering,” Kelly said. “No, no, no, so let me stop you there, because there’s three different ways that you can get the Alien Enemies Act to apply. Act of war, invasion, or predatory incursion. Trump seems to be citing the latter two.”
Trump cited invasion and predatory incursion in invoking the law.
“They don’t seem to be arguing that we’re necessarily at war with Venezuela, but, for sure, he’s saying, if you look at his declaration, it says invasion and predatory incursion,” Kelly added. “So there’s no question that you can have those other things without Congress.”
Aronberg argued that Boasberg has the ability to interpret the law to determine if the President has properly applied it.
“They’re not allowed to decide political questions, Dave,” Kelly fired back. “How is it not a political question whether we’ve suffered a predatory invasion from Venezuela?”
Kelly said that this was a national security question that was outside the powers of the judiciary.
“They never questioned our declaration of war after 9-11. They didn’t question our declaration of war with respect to Iraq or Afghanistan,” Kelly stated. “The courts have typically been reluctant to go anywhere near that kind of political declaration because they understand when you’re talking about political questions, the president is at the apex of his powers and the courts, to say they’re at their nadir, they have nothing. They have none.”
Judge Boasberg is exceeding his legal authority to make a political decision to stop Trump’s agenda.
