Attorney General Pam Bondi has publicly stated that multiple law enforcement agencies identified Garcia as an MS-13 member, including a “Maryland county police gang unit,” ICE officers, and an immigration judge.

The case triggered a fierce confrontation in the same committee just a day earlier, when Rep. Marjorie Taylor Greene (R-GA) presented evidence of Garcia’s alleged gang ties, prompting Goldman to erupt in protests.

“I object because she is misstating the record and the facts. That is not accurate, and therefore I object to that being introduced,” Goldman shouted during Tuesday’s hearing. “There is no final court order establishing that he’s a member.”

That earlier outburst set the stage for Wednesday’s confrontation with Secretary Noem, who has made cracking down on gang-related border crossings a cornerstone of her leadership at DHS.

Democrats and Republicans at odds over immigration priorities

The heated exchange between Noem and Goldman exemplifies the stark contrast in how the two parties approach immigration enforcement under the Trump administration.

Republicans have prioritized public safety concerns and swift action against those with suspected ties to criminal organizations, while Democrats have emphasized due process and legal procedures.

“The American people don’t want MS-13 members in their communities,” Noem stated during the hearing. “I’m focused on protecting American citizens from violent criminals, not fighting to bring them back into our country.”

For his part, Goldman insisted that proper legal procedures must be followed regardless of the accusations, arguing that evidence should be presented through proper channels before deportation decisions are made.

“Maybe he is [in MS-13]! So you should put all that evidence before a judge, and if he is MS-13, he should be deported,” Goldman had argued in the previous day’s hearing.

The exchange highlighted Secretary Noem’s direct style that has made her a rising star in Republican circles. Since taking over as DHS Secretary, Noem has overseen a significant increase in deportations of individuals with suspected gang ties and implemented stricter border enforcement measures.
