Democratic lawmakers introduced a bill this year to expand the Supreme Court from nine justices to thirteen.
Hillary Clinton just confirmed on a podcast why Democrats actually want those extra seats.
Six words out of her mouth say more about the plan than any press release ever could.
Clinton Said She Wants the Court Expanded While Democrats Are in Power
Clinton made the comments on High Stakes, the new midterms podcast she launched with Kara Swisher.
Swisher raised the idea of term limits for Supreme Court justices as a middle-ground reform.
Clinton rejected it outright.
"I think that term limits are artificial," Clinton said.
Then she went further than term limits ever could.
"I think instead, we should seriously look at expanding the court while the Democrats are in power," Clinton said.
She argued that because the country has thirteen federal circuits, the Court should have thirteen justices to match.
Notice the condition she attached without blinking: while the Democrats are in power, not when the Court's caseload demands it or to restore balance for the long term.
While Democrats hold the gavel.
FDR Tried the Same Move in 1937 and His Party Buried It
This is not a new idea, and it did not work the last time a Democrat tried it.
Franklin Roosevelt proposed adding justices to the Supreme Court in 1937 after the Court struck down several of his New Deal programs.
His party's Senate Judiciary Committee killed the plan, calling it exactly what it was: an attempt to change the Court's rulings, not its workload.
The Court had nine justices then. It still has nine justices now.
Congress has added judgeships before, but only to handle rising caseloads, not to overrule the people already sitting on the bench.
Clinton's plan has nothing to do with caseloads.
Today's Court hears about half the caseload it carried in the 1980s.
There is no backlog to fix. There is only a conservative majority Democrats want gone.
Two Justices on the Right Already Prove Her Math Is Wrong
Congress can change the number of justices by ordinary statute, which is exactly why Clinton's plan is dangerous rather than just distasteful.
It would not require a constitutional amendment, only votes Democrats do not currently have in the Senate.
But the premise collapses the moment you look at who actually sits on the Court right now.
Chief Justice John Roberts and Justice Amy Coney Barrett are both part of the conservative majority Clinton wants to dilute.
Neither one votes as a reliable rubber stamp for conservative outcomes, and both have broken from the right on major cases.
Clinton is not proposing a Court that reflects the Constitution more faithfully.
She is proposing a Court that reflects her party more reliably.
Start with what is actually sitting on the Court's docket for Democrats to erase.
This is the same majority that overturned Roe v. Wade in Dobbs v. Jackson Women's Health Organization.
It is the same majority that struck down race-based college admissions in Students for Fair Admissions v. Harvard.
It is the same majority that expanded gun rights in New York State Rifle & Pistol Association v. Bruen.
Four new seats would not need to overturn the Constitution to erase all three rulings. They would only need four votes.
Clinton is not out on a limb by herself.
Kamala Harris has already named expanding the Supreme Court as one of the reforms Democrats are weighing for when they next hold full control of Washington.
Clinton said this on tape, two years before the next presidential election decides who gets to make the next nomination.
She just told Americans exactly how far her own party would go to lock in power if voters hand them the chance.
What happens the first time Republicans decide they would like thirteen justices too?
