Democrats will do anything to promote their radical agenda, including willfully ignoring the Constitution.
But more and more courts are standing up to the radical Left’s unconstitutional schemes.
That’s why Gavin Newsom was spitting mad after a federal Judge overturned this California law for violating the Constitution.
And just like that, it’s now legal to own an AR-15 and other so-called “assault weapons” in California again.
Correcting decades of violating the Constitution
A federal judge recently overturned California’s decades-long ban on so-called “assault weapons,” allowing the trade and possession of the weapons.
U.S. District Court Judge Roger T. Benitez struck down the Golden State’s 1989 ban in a 79-page ruling.
Benitez’s decision came as a result of litigation by two pro-gun groups, the Second Amendment Foundation and the Firearms Policy Coalition, as well as individual plaintiffs.
Judge Benitez’s ruling was a huge victory for the rule of law, gun owners, and the Constitution, and he issued a brutal smackdown of the anti-gun radicals.
In his ruling, Benitez cited the lawful use of semi-automatic rifles in defense of life.
He even questioned why such incidences were less publicized than tragic mass shootings.
“We hear constantly about mass shootings for days and weeks and on anniversaries,” Benitez wrote. “But how often do we celebrate the saving of the life of Jane Doe because she was able to use a semi-automatic weapon to defend herself and her family from attackers?”
These guns are not the problem
Benitez further pointed out that violent crime involving the use of these misnamed “assault weapons” is actually very rare in California.
“In California, while modern semiautomatics are not rare, they are rarely the problem,” he added. “For example, in 2022, only three ‘assault weapons’ were used in violent California crimes, according to the Attorney General’s annual report, ‘Firearms Used in the Commission of Crimes.’”
Benitez blasted the California legislature for completely ignoring the Second Amendment by passing the 1989 law that banned the new sale and possession of the weapons, calling the existing arrangement “constitutionally untenable.”
Not surprisingly, California’s radical Democrat Governor Gavin Newsom attacked Judge Benitez in a tweet following the ruling.
Newsom, who is a proponent of using a Constitutional Convention (Con-con) to repeal the Second Amendment, accused Benitez of being an “NRA puppet.”

While Newsom’s rant against Benitez is laughable, this isn’t the first time the federal Judge has shot holes in California’s radical gun control laws.
Benitez also struck down California’s unconstitutional ban on the new sale of standard-capacity magazines.
While Newsom and the anti-gun leftists are seething over Benitez’s rulings upholding the Constitution, gun owners, conservatives, and those who support the Constitution and rule of law are celebrating the victory.

But the ruling isn’t the end of this battle.
Benitez stayed the application of his ruling for ten days to give California Attorney General Rob Bonta an opportunity to appeal the decision.
And even if the appeal by the Democrat Attorney General is not successful, it is expected the state will appeal to higher courts.
