Controversial Fulton County District Attorney Fani Willis’ case against Donald Trump is taking on water.

It’s now Willis – and not Trump and his co-defendants – who is in the crosshairs.

And Fani Willis has a lot of explaining to do after this new scandal exploded.

Judge Scott McAfee is facing a major decision about disqualifying Willis from the case following a two-day hearing where McAfee heard testimony from witnesses about Willis’ affair with special prosecutor Nathan Wade, if it began before Willis hired Wade onto the Trump case, and if Willis financially benefited from the arrangement as Wade paid for the two to go on vacations using the money he earned from prosecuting Donald Trump.

Testimony from former Willis friend Robin Yeartie and text messages from Wade’s former law partner Terrence Bradley undercut sworn statements by Willis and Wade that the affair only began after Willis hired Wade as special prosecutor.

To many critics, this seemed like an open and shut case where Willis hired her lover and then the two used the case to fund their vacation travel, which should result in Judge McAfee disqualifying Willis and her entire office from the case.

Due to how Georgia assigns prosecutors, disqualifying Willis likely means this case goes away for good.

But now Judge McAfee’s impartiality is being classed into the question.

The Daily Caller exclusively reported that McAfee donated $150 to Willis for her campaign for Fulton County District Attorney when McAfee worked as assistant U.S. Attorney for the Department of Justice.

McAfee previously worked under Willis at the complex trial division in the Fulton County District Attorney’s Office.

The Georgia Judicial code of conduct states that Judges should “avoid both impropriety and the appearance of impropriety in their professional and personal lives.”

Legal experts are split on whether McAfee needs to disclose this donation to defense lawyers.

“The donation itself is more or less a token amount and was made prior to his becoming a judge,” criminal defense Attorney Philip Holloway told the Daily Caller. “But failure to disclose to the defendants a political donation to the prosecutor can be seen as a present appearance of a conflict of interest. Judges are required to avoid even the appearance of a conflict of interest.”

“It is such a routine part of how Georgia judges and attorneys interact that I don’t think it should have been disclosed, necessarily, past the mandatory disclosures,” Atlanta-based criminal defense attorney Andrew Fleischman said in a statement to the Daily Caller.
