Judge issues temporary restraining order to stop birthright citizenship executive order 

On day one, Donald Trump signed an executive order ending birthright citizenship for the children of illegal aliens.

The idea of birthright citizenship comes from the 14th Amendment.

“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside,” the amendment reads.

The members of Congress and the states that ratified the 14th Amendment understood it to be granting citizenship to newly freed slaves following the Civil War.

Its purpose was to overturn the Dred Scott decision, where the court ruled that slaves weren’t American citizens since they were of African descent.

It’s only in recent decades that the 14th Amendment was interpreted to apply to the children of illegal aliens, creating what are now known as “anchor babies.”

Democrat State Attorneys General sued hours after Trump signed the executive order and the case ended up in front of Judge John C. Coughenour in Washington State.

Judge Coughenour ranted about the order declaring, “I’ve been on the bench for over four decades. I can’t remember another case where the question presented is as clear as this one. This is a blatantly unconstitutional order.”

And Judge Coughenour issued a 14-day temporary restraining order blocking enforcement.

Trump told reporters this wasn’t unexpected as Democrats handpicked this judge to hear the case for a reason.

“Obviously, we’ll appeal it,” Trump said in the Oval Office. “They put it before a certain judge in Seattle, I guess. Right? And there’s no surprises with that judge.”

This case is destined for the Supreme Court.

Blaze host Steve Deace explained that a “little birdie” in Trump world explained that Trump planned to win at the Supreme Court by arguing that since there is an invasion at the border, birthright citizenship doesn’t apply to illegal aliens.

“The best argument is that a president has power to end birthright citizenship if it’s an invasion. Whoever on Trump’s team that crafted his EO appears to be following an opinion from Federal Judge Jim Ho making that case (or what we call in my legal circles “The Ho Invasion Theory”),” Deace began.

Deace said that under the current legal framework, there weren’t the votes to end birthright citizenship, but that by reframing the question around the national emergency Trump declared at the southern border, Trump may be able to win the day.

“I’m not sure even Clarence Thomas agrees yet with ending birthright citizenship whole cloth. But I do think more judges would be willing to sign on to ending it under the guise of a president stopping an invasion as opposed to a governor like when Texas tried this,” Deace added.

In the first term, the court upheld Trump’s travel ban on the grounds that Presidents had wide latitude to act in the interest of national security.

Trump’s lawyers are planning to put that argument in front of the Supreme Court.

“Because presidents have wide constitutional latitude when it comes to matters of national defense, and these illegal aliens are causing enough harm to be treated as enemy combatants. Or at the very least this level of invasion has the potential to. And most agree that so-called birthright citizenship does not apply to enemy combatants,” Deace concluded.
