CNN legal expert defends Trump’s deportation flight against a rogue judge
President Donald Trump invoked the Alien Enemies Act of 1798 to deport more than 250 members of the bloodthirsty Venezuelan prison gang Tren de Aragua.
The law allows the President to detain and deport noncitizens if they pose a national security threat to the country.
Trump issued an executive order that declared Tren de Aragua a foreign terrorist organization.
District Court Judge James Boasberg, who was appointed by former President Barack Obama, issued a ruling blocking the deportations.
Two planes carrying the gang members were in the air when the judge ordered them to turn around and return home.
But the planes continued to their destinations in El Salvador and Honduras.
Democrats and their public relations team in the media shouted from the rooftops that Trump defied a court order by not having the planes return to the United States.
CNN senior legal analyst Elie Honig argued that the Trump administration didn’t defy the judge’s order if the planes were outside American airspace.
“They came right close to the line and maybe over it and let me give you the specific details we need to know in order to make this determination,” Honig explained. “At the moment the judge gave the order, he said in court on Saturday afternoon, ‘I want you to not fly anyone out of here or if flights are already in the air I want you to turn them around.’”
The crucial detail was the plane’s location.
“At that very moment, where were the airplanes?” Honig asked. “If they were already on the ground in the United States, then yes, there was a defiance of the order. If they had already landed in El Salvador, then no, there was no defiance of the order, it was already too late.”
Honig claimed that if the planes were already in the air then things were less clear.
“If they are mid-flight, then we get into questions of where were they? Were they over American territory or international waters? And that’s some grey area. That may give the Trump administration something to hang their hat on,” Honig added.
White House says the planes were outside American airspace
White House Press Secretary Karoline Leavitt said that planes were outside the United States and the Obama judge didn’t have the authority to order them to turn around.
“The Administration did not ‘refuse to comply’ with a court order. The order, which had no lawful basis, was issued after terrorist TdA aliens had already been removed from U.S. territory,” Leavitt wrote on social media.
She argued that the judges didn’t have any power over the President exercising his conduct of foreign affairs under the Constitution.
Democrat judges are getting bolder about overstepping their authority to stop Trump from using his constitutionally prescribed powers.
The Left doesn’t want Trump to be President and judges are their only means to stop him.
Democrats and the media put themselves in the awful position of defending violent illegal alien gang members remaining in the United States in their never-ending fight with Trump.
