Democrats are in panic mode over this Supreme Court Justice’s retirement decision

The Supreme Court is a source of rage for the Democrat Party.

Anger levels are about to go through the roof.

And that’s because Democrats are in panic mode over this Supreme Court Justice’s retirement decision.

Democrats fear Supreme Court déjà vu 

Anxiety on the Left is rising over Donald Trump winning the 2024 election and recreating what happened in 2020 when Trump cemented a 6 to 3 conservative majority on the Supreme Court by nominating Amy Coney Barrett following Ruth Bader Ginsburg’s death.

That’s leading to a growing movement in the Left’s chattering classes to begin a campaign to pressure liberal Supreme Court Justice Sonia Sotomayor to step down now while Democrats still control the Presidency and the Senate.

Liberal pundit Josh Barro made the case in a piece posted to his Substack that Democrats could end up in the political wilderness for a while, which could lead to Donald Trump expanding the current Supreme Court majority to 7 to 2 conservatives.

“But if Sotomayor does not retire this year, we don’t know when she will next be able to retire with a likely liberal replacement. It’s possible that Democrats will retain the presidency and the Senate at this year’s elections, in which case the insurance created by a Sotomayor retirement won’t have been necessary. But if Democrats lose the presidency or the Senate this fall (or both) she’ll need to stay on the court until the party once again controls both. That could be just a few years, or it could be a while — for example, Democrats have previously had to wait 14 years from 1995 to 2009, and 12 years from 1981 to 1993,” Barro wrote.

A difficult case for Biden to make 

Sotomayor is 11 years younger than Joe Biden.

And comparatively speaking, she hasn’t been on the court for very long, as the Senate confirmed her in 2009.

An 81-year-old Biden telling Sotomayor she needs to step down for the good of the Democrat Party as he runs for re-election with polls showing a supermajority of voters think he’s too old to be President would be a tough sell.

Some liberals think a Supreme Court nomination fight would play to Biden’s political benefit.

Polling analyst Nate Silver argued Biden nominating a younger, rising-star leftist jurist to the Supreme Court would help unite the Democrat Party, which is currently fractured over the border and Israel.

“Clearly, the +EV move if progressives want to maximize the chance of a more progressive or at least not 7-2 Supreme Court. 50x more important than most of the stuff people argue about on here. But unlikely to happen because That’s Not How Things Are Done,” Silver posted on social media.

In 2016, a divided Republican Party eventually united around Donald Trump over the issue of filling the Supreme Court vacancy created by Justice Antonin Scalia’s death.
