Democrats found a new weapon to sabotage Trump's agenda.
Activist judges are doing their dirty work for them.
But Alina Habba just exposed the blue slip scam that Democrats wanted to keep hidden after activist judges blocked the Trump prosecutor.
Three Judges Override The Will Of The People
A three-judge panel on the U.S. Court of Appeals for the 3rd Circuit ruled unanimously Monday that Alina Habba can't serve as New Jersey's top federal prosecutor.¹
Never mind that Trump won a landslide mandate in November specifically to clean up corrupt Democrat-run states like New Jersey.
Never mind that Habba is eminently qualified as Trump's former personal defense lawyer who fought the weaponized justice system for years.
The courts decided they know better than the President and the 77 million Americans who voted for him.
Here's what really happened: New Jersey's two Democrat senators, Cory Booker and Andy Kim, refused to approve Habba using an archaic 100-year-old tradition called the "blue slip."
This obscure Senate courtesy gives home-state senators veto power over federal prosecutors in their states — even when the President has constitutional authority to make those appointments.
Democrats are weaponizing it to protect their corrupt allies from investigation.
Habba made clear she planned to investigate New Jersey's Democrat Governor Phil Murphy and Attorney General Matt Platkin.
She said she wanted to help "turn New Jersey red."
That's when Democrats panicked and pulled out every procedural trick to stop her.
Trump Administration Tried To Work Within The System
When Habba's 120-day interim appointment expired in July and the two Democrat senators blocked her confirmation, the Trump administration got creative.
Attorney General Pam Bondi designated Habba as "Special Attorney to the Attorney General" and named her first assistant U.S. attorney, delegating her the authority to do the job.
The administration was following the law — using existing statutory provisions to fill a vacancy when Democrats were abusing Senate procedures to leave the position empty.
But activist judges saw an opportunity to kneecap Trump's law enforcement agenda.
"The Trump Administration's argument would effectively permit anyone to fill the U.S. Attorney role indefinitely," the panel wrote.² "This should raise a red flag."
Wait — so letting the duly-elected President fill vacancies in his own Justice Department is now a "red flag"?
These same judges had no problem when Obama stacked federal prosecutor offices with his loyalists for eight years.
Two of the three judges were appointed by George W. Bush — establishment Republicans who never liked Trump to begin with.
The third was an Obama appointee, naturally.
The Blue Slip Scam Democrats Are Running
The blue slip tradition dates back more than a century, originally designed as a courtesy when senators actually worked with presidents in good faith.
Democrats turned it into a weapon.
They're using blue slips to block Trump's prosecutors in every blue state — New Jersey, New York, California, Nevada, Virginia.
Senate Judiciary Committee Chairman Chuck Grassley refuses to override the tradition, arguing that Republicans used it to block some of Biden's worst judicial nominees.
But there's a massive difference.
Republicans blocked radical leftist judges who wanted to shred the Constitution.
Democrats are blocking tough-on-crime prosecutors who want to investigate actual corruption in their states.
Trump has been raging against this obstruction for months, calling the blue slip "stupid and outdated" and demanding Grassley bypass it.³
"Chuck Grassley should allow strong Republican candidates to ascend to these very vital and powerful roles, and tell the Democrats, as they often tell us, to go to HELL!" Trump posted on Truth Social.
Grassley won't budge, leaving Trump's prosecutors twisting in the wind while Democrats celebrate.
This Is Happening In Multiple States
Habba isn't the only Trump prosecutor getting blocked by activist judges doing Democrats' bidding.
Last week, U.S. District Judge Cameron Currie dismissed criminal indictments against former FBI Director James Comey and New York Attorney General Letitia James.
Currie ruled that interim U.S. Attorney Lindsey Halligan was unlawfully appointed to lead prosecutions in Virginia's Eastern District.
Halligan had just indicted Comey for lying to Congress about the Russia hoax — you know, the massive conspiracy to frame Trump that Democrats want buried forever.
She also indicted Letitia James for bank fraud.
Both cases got thrown out because the judge decided Halligan shouldn't have the job.
Federal judges in California and Nevada issued similar rulings blocking Trump prosecutors Bill Essayli and Sigal Chattah.
Notice the pattern?
Every single one of these prosecutors was investigating Democrats or prosecuting Trump's political enemies.
Every single judge who blocked them gave Democrats exactly what they wanted — a get-out-of-jail-free card.
The Trump administration is now 0-for-4 in these challenges, with activist judges finding new excuses to reject prosecutors who won't protect the Democrat establishment.
What This Really Means
"The case is the first challenge of the Trump administration's process for selecting US attorneys to be heard by a federal appeals court," CNN reported.⁵ "While the 3rd Circuit's decisions cover New Jersey, Pennsylvania, Delaware and the US Virgin Islands, appeals court cases are often given deference in other parts of the country."
Translation: This ruling gives activist judges across America a blueprint to block Trump's prosecutors everywhere.
Democrats figured out they can't beat Trump at the ballot box.
They can't stop his Cabinet confirmations because Republicans control the Senate.
So they're using the blue slip tradition and sympathetic judges to make sure Trump can never clean up corruption in blue states.
It's the Deep State in action — unelected bureaucrats and judges overriding the will of the American people.
The Federal Vacancies Reform Act was supposed to help presidents fill positions quickly when needed.
Now judges are twisting it into a weapon against Trump, claiming he's "exploiting loopholes" when he's just trying to staff his own Justice Department.
Habba had prosecutorial authority delegated from the Attorney General.
She had the legal right to investigate corruption in New Jersey.
But that's exactly what Democrats couldn't allow.
Governor Murphy and AG Platkin were about to face real scrutiny for the first time.
New Jersey's corrupt political machine was finally going to be held accountable.
Democrats pulled strings, judges obliged, and now those investigations are dead.
Trump can appeal to the full 3rd Circuit or take this to the Supreme Court.
But how many more months will that take while corrupt Democrats keep operating with impunity?
This is why Trump warned voters about the Deep State.
This is why draining the swamp is so hard.
You're not just fighting elected Democrats — you're fighting an entire system of judges, bureaucrats, and establishment Republicans who want things to stay exactly as they are.
Trump won the election to fix this mess.
Activist judges just told 77 million Americans their votes don't matter as much as a 100-year-old Senate courtesy that Democrats weaponized.
