Donald Trump is set to take office on January 20.

Judge Merchan’s ludicrous ruling
Judge Juan Merchan predictably ruled against Donald Trump’s motion to vacate the guilty verdict in Alvin Bragg’s falsification of business records show trial in light of the Supreme Court’s ruling on Presidential immunity.
Bragg introduced as evidence official acts of Trump in office, which the Supreme Court ruled was unconstitutional.
Merchan was never going to admit he got the trial all wrong so he let the verdict stand by just ignoring that aspect of the Supreme Court’s ruling.
“The People’s use of these acts as evidence of the decidedly personal acts of falsifying business records poses no danger of intrusion on the authority and function of the Executive Branch,” Merchan’s ruling read.
“To find otherwise would effectively mean that every statement ever uttered (or posted on social media) by a sitting president, whether personal or official, in his or her own interests or that of the country, would be protected by absolute immunity,” Merchan added.
The verdict hands over Trump’s Presidency
Fox News legal analyst and George Washington Law School professor Jonathan Turley warned that Merchan leaving the verdict in place and delaying sentencing until Trump leaves office in 2029 is a horrific development for Trump.
“Bragg is still suggesting that the court could leave Trump in suspended legal animation – serving as president awaiting a sentence,” Turley stated.
Turley wrote that pushing sentencing off for four years will “allow Merchan to hold the leash on a president for four years.”
“Given the unlikelihood of a jail sentence, it is the preferred option for many Democrats who want to have Trump govern with an asterisk of a ‘President pending sentencing,’” Turley added.
Trump responded to the verdict by pointing out another way Merchan’s ruling violates the Constitution.
That’s because Merchan putting off sentencing allowed him to keep the gag order in place.
If Trump criticizes Bragg’s prosecutors or Merchan’s family conflict of interests – Merchan’s daughter ran a political consulting firm that did work for California Senator-elect Representative Adam Schiff (D-CA) and Vice President Kamala Harris – Merchan could theoretically use that to fine and eventually jail Trump.
Trump cited the number of legal experts – on both the Left and the Right – who found the result of this case appalling and argued Trump would likely win on appeal.
“I am the only Political Opponent in American History not allowed to defend myself – A despicable First Amendment Violation! Merchan took the Manhattan D.A.’s Witch Hunt, that, according to all Legal Scholars, including Jonathan Turley, Elie Honig, Andy McCarthy, Alan Dershowitz, Gregg Jarrett, David Rivkin, Elizabeth Price Foley, Katie and Andy Cherkasky, Paul Ingrassia, and many others, is a nonexistent case, barred by the Statute of Limitations, and should have never been brought and, through his fraud and misconduct, gave it a semblance of ‘life,’” Trump wrote on Truth Social.
Trump argued that Merchan was even more corrupt and partisan than Jack Smith and that Merchan won’t rule correctly to vacate this verdict simply because he wants to tar Trump’s legacy by branding him a convicted felon.
“While Deranged Jack Smith was sent packing back to The Hague after losing all of his politically manufactured cases against me, Merchan, who is far worse and even more corrupt than Smith in his fight for my hopeless political opponents, just cannot let go of this charade. Is it because of his conflicts and relations that he keeps breaking the Law? This has to stop! It is time to end the Lawfare once and for all, so we can come together as one Nation and, Make America Great Again,” Trump concluded.
